1. Acceptance of Terms
By accessing or using Pass-IT ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.
2. Description of Service
Pass-IT is an AI-powered exam preparation platform that provides practice questions, mock exams, and personalized learning experiences for certification exams and custom study topics. The Service uses artificial intelligence to generate questions, provide explanations, and track your progress.
3. User Accounts
3.1 Account Registration
To use certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.2 Account Security
You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through your account settings.
3.4 Age Requirements
You must be at least 16 years of age to use this Service (in compliance with GDPR). Users between 13-16 may only use the Service with verifiable parental consent. By using the Service, you represent that you meet these age requirements.
4. Subscriptions & Payments
4.1 Subscription Plans
Our Service offers a free tier and paid subscription plans. The Free plan provides limited access (30 questions/month, 2 certification topics). The Pro plan provides unlimited access for a monthly or annual fee. Plan details and pricing are displayed on our website and may change.
4.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings or the App Store/Google Play.
4.3 Payment Processing
Payments are processed securely through Stripe (web) and RevenueCat/Apple/Google (mobile). By making a purchase, you agree to the applicable payment processor's terms of service. We do not store your full payment card details on our servers.
4.4 Pricing Changes
We reserve the right to change subscription prices at any time. Price changes will be communicated in advance and will take effect at the start of your next billing cycle. Existing billing periods are not affected by price changes.
5. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Share your account credentials with others or create multiple accounts to abuse free tier limits
- Attempt to reverse engineer, decompile, or extract the source code of the Service
- Use automated systems (bots, scripts) to access the Service without authorization
- Upload content that infringes on intellectual property rights or contains malware
- Attempt to gain unauthorized access to other users' accounts or data
- Use the Service to generate content for redistribution or resale
- Interfere with or disrupt the Service or servers
- Violate the rights of others or engage in harassment or abusive behavior
6. Intellectual Property
6.1 Service Content
All content provided by Pass-IT, including the platform interface, AI-generated questions, explanations, and analytics, is owned by Pass-IT or its licensors and protected by copyright, trademark, and other intellectual property laws.
6.2 User Content
You retain ownership of content you upload (study materials, documents). By uploading content, you grant us a license to use, store, and process it to provide the Service. You represent that you have the right to upload and share this content.
6.3 Generated Content
Practice questions and explanations generated by our AI based on your uploaded materials are for your personal use only. You may not redistribute, sell, or publicly share AI-generated content without our permission.
7. AI & Third-Party Services
7.1 AI-Generated Content
Our Service uses Anthropic's Claude AI and other AI technologies. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You should verify important information and not rely solely on AI-generated content for exam preparation.
7.2 Third-Party Services
We use third-party services including Anthropic (AI generation), Stripe and RevenueCat (payments), and Cloudflare R2 (file storage). Your use of these services through our platform is subject to their respective terms of service and privacy policies.
8. Data Privacy
Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
9. Disclaimers and Limitations
Pass-IT is provided "as is" without warranties of any kind:
- We do not guarantee that the Service will be error-free, uninterrupted, or secure
- We do not guarantee that AI-generated content is accurate, complete, or suitable for passing exams
- We are not responsible for certification exam content or policies of certification providers
- Your exam results depend on many factors beyond our control, and except as expressly provided under our Money-Back Guarantee Program (Section 13), we make no guarantees about exam outcomes
10. Limitation of Liability
To the maximum extent permitted by law:
- Pass-IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for losses resulting from unauthorized access to your account, data loss, or service interruptions
- Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you
EU Consumer Rights: If you are a consumer in the European Union, you retain all mandatory consumer rights under EU law, including the right to withdraw from a contract within 14 days of purchase for digital content that has not been fully performed.
11. Indemnification
You agree to indemnify and hold harmless Pass-IT, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload or share through the Service
12. Exam Disclaimer
IMPORTANT: Pass-IT is an independent study tool and is not affiliated with, endorsed by, or sponsored by any certification provider, exam organization, or testing authority. Certification and exam names are trademarks of their respective owners.
We do not have access to actual exam questions and do not provide "dumps" or leaked exam content. All practice questions are generated by AI based on publicly available information and your study materials. Except as expressly provided under our Money-Back Guarantee Program (Section 13), using our Service does not guarantee you will pass any exam.
13. Money-Back Guarantee Program
13.1 Guarantee Terms
Pass-IT offers a money-back guarantee to Pro subscribers who fail a certification exam after meeting defined study requirements. Eligibility criteria, claim process, and refund details are described in our Refund Policy (Section 2).
13.2 Limitations
- The guarantee is available only to active Pro subscribers; it does not apply to the free plan
- One guarantee claim per certification per account lifetime
- All eligibility criteria must be met at the time of the exam
- Claims are subject to admin review; Pass-IT has final review authority on all claims
- Pass-IT reserves the right to modify, suspend, or discontinue the guarantee program at any time with reasonable notice
- Changes to the guarantee program will not affect claims already submitted
13.3 Refund Method
For subscriptions purchased via Stripe (web), approved guarantee refunds are processed through Stripe. For subscriptions purchased via Apple App Store or Google Play, approved claims are acknowledged by Pass-IT but refunds must be requested directly through Apple or Google.
14. Partner and Affiliate Program
14.1 Eligibility
Participation in the Pass-IT Partner Program requires an application and is subject to approval at our sole discretion. We reserve the right to reject or revoke any application or membership.
14.2 Commission
Approved partners earn a 15% recurring commission on payments from subscribers they refer. Commissions are earned for 12 months from the date of each referral.
14.3 Payment
Commission payments are subject to a 30-day hold period to account for refunds and chargebacks. A minimum payout threshold of $50 applies. Payments are processed through Stripe Connect.
14.4 Attribution
Referrals are attributed on a first-touch basis via unique referral links. Once a user is attributed to a partner, the attribution is permanent for the 12-month commission window.
14.5 Termination
Either party may terminate the partner relationship at any time. Upon termination, commissions on existing referrals will be honored through the 30-day hold period for any commissions already earned.
14.6 Code of Conduct
Partners agree not to:
- Make misleading, false, or exaggerated claims about Pass-IT or the guarantee program
- Engage in spam, unsolicited messaging, or deceptive advertising practices
- Create self-referrals or use fraudulent means to generate referral credits
- Use Pass-IT trademarks in a manner that implies official endorsement beyond the partner relationship
Violation of the code of conduct may result in immediate termination and forfeiture of unpaid commissions.
14.7 Tax Responsibility
Partners are solely responsible for reporting and paying any taxes owed on commission income. Pass-IT may request tax identification information as required by applicable law.
15. Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Switzerland. The courts of Zurich, Switzerland shall have exclusive jurisdiction over any disputes, except where mandatory consumer protection laws of your country of residence provide otherwise.
15.2 Arbitration
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits.
15.3 Exceptions
Either party may seek injunctive relief in court for intellectual property infringement or violations of confidentiality obligations.
16. User Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us an unlimited, perpetual, irrevocable license to use, modify, and incorporate such feedback without compensation or attribution to you.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and any applicable Partner Program terms, constitute the entire agreement between you and Pass-IT regarding the Service and supersede all prior agreements and understandings.
